Terms of Service

These terms cover your use of VortexPrism, operated by Gitspark Technologies LLC. The product is early, and this page says so where it matters rather than describing a service we have not built yet.

What the service is

VortexPrism gives an application one place for sign-in, product analytics and subscription state, reached through an SDK and a dashboard. You use it by creating a project and sending us data from your own application.

Your account

  • You must be able to enter a contract, and you are responsible for what happens under your account.
  • Keep your credentials and your project keys secret. A project key can send data as your application.
  • Tell us promptly if you think an account or key has been compromised.

Your data, and what you owe your own users

The data your application sends us stays yours. We process it to run the service for you and do not use it for our own purposes, do not sell it, and do not train models on it.

You decide what to collect about the people who use your application, so those obligations are yours: have a lawful basis for collecting it, publish your own privacy notice, obtain consent where the law requires it, and honour requests from your users. We will help you act on such a request — see the Privacy Policy for how that works today.

Do not send us special category data — health, biometrics, precise location, government identifiers, payment card numbers — unless we have agreed it in writing first.

Acceptable use

  • Do not use the service to break the law or to infringe anyone’s rights.
  • Do not attempt to reach another customer’s data, probe the service for vulnerabilities without asking us first, or work around usage limits.
  • Do not resell the service as your own product without an agreement with us.
  • Send us data about your own application’s users, not scraped or purchased lists.

If you find a security problem, tell us at gitspark@gitspark.com before telling anyone else, and we will not pursue you for having looked.

Availability, while we are honest about it

The product is in alpha. There is no uptime commitment and no service level agreement. We may change or remove features, and we may take the service down for maintenance. We will give notice of a change that would break your integration where we reasonably can.

Keep your own copy of anything you cannot afford to lose. Product events are deleted automatically after two years.

Fees

VortexPrism is currently free to use, and billing is not switched on. When we do start charging, we will say what a plan costs and what it includes before it applies to you, and you will have the chance to decline and export your data.

Ending it

You may close your account at any time; doing so deletes your projects and the data in them. We may suspend an account that breaks these terms or that puts the service or other customers at risk, and we will tell you why unless the law stops us.

Liability

The service is provided as it is, without warranties of any kind. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits, or for lost data, and our total liability is limited to the greater of the amount you paid us in the previous twelve months or one hundred US dollars.

Nothing here limits liability that cannot lawfully be limited.

Changes and contact

We will post changes to these terms here, with the date above updated. Continuing to use the service after a change means you accept it.
